Children are not domestic juveniles, they are the future of our nation.

 


Next big crisis is not World War III, it is children growing up without boundaries and internalised mistrust. I say this because police are not involved most of the times when parents abuse parental authority and resort to intrusive surveillance practices as a "disciplinary" or "protective" measure rather than a constitutional violation

so, the law is there - but inaccesible to the victims

I recently came across a social media post, where a 14-year-old teenage girl was monitored by her parents to ensure that she is preparing for JEE Examination. But what about the mental agony, pain and damage she has gone through? 

Most minors don’t have access to legal representation. They depend on their guardians (often the violators) to initiate legal remedies.Even if they are aware of their rights, they fear reprisal, punishment, or emotional alienation from their families.

India does not provide strong safeguards for minors inside domestic spaces from moral policing to controlling behavior, which impairs the child to function normally.

What about the schools and educators? Do they talk about these invasions by parents? No, because then, the children would be labelled as "mischievous", "indisciplined" etc. But, it is the responsibility of Schools and social workers to educate children about bodily and spatial privacy as just because the victims (minors) cannot access legal remedies doesn’t mean the law should ignore the violation.

Calcutta High Court (2024) – CCTV inside Homes Case [Indranil Mullick & Ors. vs. Shuvendra Mullick 2025 SC]

This is the most direct and recent precedent relevant to the occupants inside a house. In this case (widely reported in the media in April 2024), the Calcutta High Court ruled that:

Installation of CCTV cameras within a residence requires the consent of all adult occupants.”

It did not address minors, This judgment has been affirmed by the Supreme Court few days ago, thereby giving it a binding effect. This makes me question, are these safeguards only available to those who are legally capacitated?

One of the often overlooked subject of law is child centric jurisprudence. It is not just POCSO, more such child centric laws or atleast guidelines should be issued so that children in India are aware of their rights and can grow up to become citizens with free spirit not only as enshrined in the Constitution, but also deeply felt within their hearts

Children are not domestic juveniles, they are the future of our nation. Educate them, as a parent it is your sole responsibility to educate yourself so that you become capable of teaching your child instead of resorting to measures that strip off the dignity of your child.

 Remember that the way you see your child is the way they would see themselves.
